Tenant Information
When you take on a tenancy, you are entering into a legal contract with another party, being the owner of the property. By signing the tenancy agreement you have - agreed to abide by the terms of that agreement Will not be able to vacate the property within the fixed term of the tenancy(unless by agreement with the landlord) Be liable for the rent due, even if your are claiming housing benefit. Any shortfall or claw back would have to be paid by you.
By using a reputable agent, like ourselves, we try to look after your wellbeing throughout the term of the tenancy. Giving you advice and help on any aspect of the letting. Repairs to properties are undertaken as quickly and efficiently as time will allow.
We are in a Client Money Protection scheme and a member of The Dispute Service (TDS) which runs the Tenancy Deposit Scheme (TDS) giving you the assurance that you money is safe. (Please note that this does not cover your deposit if withheld for unfair wear and tear, rent arrears or other such breaches of tenancy).
Before you are able to rent a property, you will be required to view it. If to your liking you will be asked to complete a formal application form for that property in order for us obtain financial and other references.
A copy of the tenancy agreement is available in our office for you to read prior to applying for a property. The tenancy will normally be an Assured Shorthold Tenancy.
This form of tenancy guarantees that you, as a tenant have at least security for the initial six months of that tenancy (unless you do not comply with the terms of tenancy). If created for a longer term and there is no “break clause” - a clause that says you can give one month’s notice, then you will be bound for the length of the fixed term - such as a fixed term for 12 months would bind you for 12 months.
Once a fixed term comes to an end, and if another fixed term tenancy has not been signed, you may continue to occupy the property on a periodic basis - normally month to month. Thereby, you would need to give at least once clear period notice to vacate. This period would be from your rental due date - if you paid on the 10th of the month, the notice would run from the 10th. Etc.
The Landlord can regain possession of your property at a later date by the service of a Section 21 Notice under the Housing Act 1988 (as amended by Housing Act 1996) this notice must be at least two months and if the correct procedures are followed a court order would be gained for possession.
If we act for the landlord to find a tenant only, which we term as “let only”, the deposit/bond will be transferred to the landlord. You would then deal direct with that landlord as we would not be in the position of stakeholder.
We normally provide you with a condition report and inventory however, you should always make your own notice and take photographs were necessary when you take occupation. A copy of these notes together with the photographs should be given to us. This will help us at the end of the tenancy to determine any unfair wear and tear.
If you enter into a JOINT TENANCY with others, you will be jointly responsible for ALL the RENT and DAMAGES as if you alone were renting the property.
THEREFORE, you MUST make sure that you are happy to reside with the other person(s) as any actions from them may result in YOUR part of the total amount of Deposit/Bond held being retained should any rent be outstanding or damages found (Over and above fair wear and tear) even if you, yourself have paid all your rent or have not committed any damage.
Gardens (where applicable)
During the growing season, lawns will need to be cut every 7 days, this will ease the problem of overgrown and unsightly gardens. Under the terms of your tenancy you are responsible for the cutting lawns and keeping the garden tidy. We expect that the garden will remain in a suitable condition throughout the tenancy and on vacation.
